Components of a Unit Foreword • The Context One of the priorities for contributing to the Lisbon strategy, namely, to make life long learning a reality by sharing a common references of principles to achieve a European credit transfer unit system as part of the education and professional training, even more directly concerns liberal jobs or more specifically the Arts as a whole. Possible solutions for the design, implementation and development of a credit transfer system compatible with the specific training flexsecurity, mobility and long adaptability for these kind of jobs, makes a priority to find simplified common rules that interface the standard VET systems traditionally derived from the law-regulated professions or with the industrial-commercial sector with a production base management and not primarily artistic. The challenge is to build up a specific ECVET-USA device (European Credit Vocational Educational Training for the Urban and Street Arts), which enables mobility, comparison and exchange of artists from the European Metropolitan cities with a legal monitoring and reporting framework system (capitalization of public donations) on artistic activities in terms of liberalized entertainment provision of services to the public (urban and street arts). In this regard has already been prepared an initial draft regulation under the european pilot project Florence (see urban-art-governance-regulation-FLORENCE.doc annex) concerning the implementation of “Metropolitan City” (Title V Italian Constitution.). Through the intergovernmental “National Code of Local Authorities” instrument in force since January 2007, it is possible to prepare, in consultation with the Italian Ministry of Economy (holder of the forced title accountability of the circulating currency) and the Ministry of Heritage and Cultural Activities (leader of the "Pact for cultural show performance" signed by the presidents of the Conference of the Regions and Autonomous Provinces, dell'UPI and dell'ANCI, dated 25 January 2007) with the common area concerned, an innovative "over-prime" project financing public strategy allowing the emergence of a"social value of the arts" for the new “metropolitan city” governance costituency in social and civil economy. In other way an added value for financial markets but with really social cohesion matter. The jurisprudence of the Italian Constitutional Court, interpretating the new Title V of the Constitution, has inserted the generic “show performance” among the areas in which carry out a concourrent legislation by the regions, as part of the fundamental principles, whose determination is reserved to state Law. Pending the process of adjustment of state and regional legislation to the new constitutional order, we can reconsider “entertainment services” to the public provided by individual or associated artists not as “live show performances” subject to the laws competitor, but rather as an activity regarding a specific rules of Metropolitan City and then relating to the implementation of Title V. This approach, by method and substance, lets you establish an European pathway opportunities for sustainable mobility of artists together with the initiatives carried out by the European Parliament towards an European legislation on artists mobility as a whole. • The challenges and the ECVET-USA scenario For the definition of ECVET-USA the most important issues that we are facing for, are related to the diversity of actors and authorities involved in the system and the structural socio-economic imbalances of the territories of the Italian Republic. Given the opportunity of a new organic and coordinated regulation for the metropolitan cities, this is not guaranteed for other regional public organizations, which often have not activated even when ex post deregulation and decriminalization under Article 121 TUPLS (public security) in the last five years; but other municipalities (100) have depenalized and liberalized tout court the street arts. - Authorities are bodies involved in defining together with the operators and artists units in terms of public spaces and timetable of operation, the methods of access to ownership of unit and validation of "non-commercial entertainment public groud units” for the arts, the determination of the number, content and credits allocated to units or operational modules; - Actors are: ministers (Education, Labor, Agriculture… Cultural Heritage), agencies, professional organizations, businesses, social partners, the Chambers of Commerce, the National Authority accredited or licensed to provide training or entertainment or other issues that deal with qualifications and credits. It is therefore essential to identify who is the legal authority especially outside of Metropolitan City, or in the minor municipalities where it's possible to practice the street art. - Qualifications, relative to the level and specialization EVT for the artists reveal a wide variety of skills ant creative classification of specialist in disciplines, levels, diplomas, certificates, accreditation systems and update qualifications morely in university and often on experimental basis with few outlets professional non-competitive quality and transparency business opporetunity especially in the field of performing arts and visual arts. The qualifications can be obtained in several ways: with one or more formal training programs, or with not formal or informal paths. The construction of training opportunities for qualifications can be based on the accumulation of points within a variable maximum point targeted to a certain territory. Depending on the systems, ECVET-USA is a decentralized system based on Metropolitan City level for voluntary Member State and actors in their VET systems, laws and rules should allow national transparency in reporting, in the recognition, certification and securiztion of quality entertainment services to implement. Member States have the responsibility to decide the implementation of ECVET-USA nationally. ECVET-USA ensures transparency: - The reporting and ceilings - Qualifications and objectives of a program of education or training or any Path learning or experience in social capitalization - Procedures targeted felxecurity recognition, evaluation and quality - Formal non-formal and informal Entertainment Units - Structures of the relatively standard VET systems in the fields of Arts, - The responsibilities of operators (artistic directors) and cooperating (artists). With regard to diversity, the issues within ECVET-USA must be compared are: - The introduction of ESBA- European Social Bourse of the Artists and the levels of coordination EQF for professionals (stakeholders-artists) - The adoption of common European principles to ensure the quality of independent productions (shareholders-artists) - The adoption of common European principles of non-formal and informal entertainment transfer units at least at regional level • TECHNICAL SPECIFICATIONS On the technical side, ECVET-USA is one part describing qualifications in terms of Operational Experience, know-how and skills (ESC- Experiences, Skills and Competences) organized in capitalized units reporting what can be transferred and accumulated, the by other points giving credit qualifications in the same unit, with particular attention to the value on each of these (territorial maximum per unity and temporal trends). These principles also provide technical provisions, application methodologies and tools in the cooperating artists service needed to put in place a concrete system; At the end, the introduction and development of the system ECVET-USA use: - A description of the main features of the system ECVET-USA - Rules, conventions and procedures for the use - The presentation of the main tools that can be used by operators, EVT experts and the certification authorities responsible in the validation of the acquired experiences A glossary - A set of questions and answers frequently asked - The list of members of the Technical Working Group ECVET-USA of the pilot project Florence. Other tools that will complete the technical specifications are: - A document to the European Cities entitled "ECVET-USA: essential characteristics" - A guide for operators and beneficiaries - Documents relating to the Partnership for the establishment of the European Co-operative Society of Urban and Street Arts (due to an approval of the pilot project by the Italian Authority) Or model agreement for implementation by the European Commission Or model to present the objectives of (unity, experience, knowledge, skills) the participated democracy with the consultations in Tuscany region. - A model documents for the registration of capitalized units depending on the country and the laws of countries (metropolitan cities) members .. 1. GENERAL • 1.1 DEFINITION OF A SYSTEM OF FORMAL URBAN AND STREET ARTS ENTERTAINMENT CAPITALIZED UNITS A entertainment capitalized unit can compose a qualification or objectives of a program of education and training at least on an individual basis and coordinated in its composition. In economic content, each unit is defined in terms of ESC characterized by periods of credit or other accumulation coefficients that define its scope and value, and it can also be validated independently with legal form regarding the accumulation. • 1.2 PRELIMINARY DEFINITIONS THE ENTERTAINMENT UNIT is the smallest part of a certification, experience, qualification, a diploma, subject to accreditation, evaluation and validation, which may be specific to a single common experience or a variety of experience and qualifications. THE ECVET-USA POINTS OF CREDIT are one of the tools that are given to facilitate the implementation of the system at national and European level, in the context of transnational mobility of artists They are used by operators and stakeholders tractations and are related to the qualifications and the units. • 1.3 ECVET-USA DEFINITION ECVET-USA is a European capital, accumulation and transfer of entertainment units designed for mobility, the assurance and training of artists in Europe, in order to certify and record the experiences gained from the agent engaged in a continuous path of learning-mobility-job. It thus facilitates the processes set out above in relation to particular paths training-job-experience abroad but also at regional and interregional as well as formal and non-formal education. ECVET-USA aims to enhance the experience of the artist, however acquired, and is designed to operate at European level by ensuring the conditions for a market regulated arts based sull'accumulo and transfer of units capitalized by the same artists as operators called cooperative competition with operators of non-regulated markets of traditional performing arts. • 1.4 TECHNICAL PRINCIPLES The European capitalized unit for the urban and street arts EVT is aimed to lifel long learning migrant artists who will envalue their ESC progressively acquired and / or transfered as vocational training roll-bridge transitions from one qualification to another, a system of qualification to another or from one country to another, taking into account the rules and procedures relating to national assessment of skills and experiences gained accredited and/or accumaleted. Its implementation is based on: - Validation of the acquired progressive: ESC (in formal and non-formal) - Capitalization and accumulation units and credit points for the part of intermediaries accredited to self-traing project tread, it is noted that the value of unity and points of credit for dealing applies to accumulate at least every six months. - The transfer of the experience acquired: units and credit points obtained are transferable from one roll-bridge to another and recognized between countries - Openness (transparency) and mutual trust among regional partners: The authorities responsible for units and the unit managers implement procedures for the service activation of the rules of a mutual administration system (public and private), in order to foster a climate of trust that is essential to put in place effective ECVET-USA . The system does not replace existing national ones for the accumulation and / or transfer of capitalized units c for “live show entertainment” industry activitiesnot yet scheduled nowaday in any European country. Adherence to ECVET-USA is voluntary and institutions in each country implementing the conditions of application and the laws and regulations necessary (street arts and arts urban). It is a system applicable in those States that possess: - A system for the recognition of the capitalized entertainment unit on a commercial basis with state aid (eg France with pre-competitive approach) - One or more systems level for the accumulation and transfer of units to be capitalized in EVT with competitive approach - A national framework of qualifications or equivalent system with innovative ways (such as cooperative concurrency in Brand Mark Metropolitan Cities) • 1.5 FUNCTIONS OF ECVET-USA The system UACVET has two functions, which can be taken individually or simultaneously: I. Capitalization and accumulation: ECVET allows all artists who want to entertain the public freely in the streets and in metropolitan areas to capitalize, and earn enforcing what acquired in their own individual experience abroad in the bridge-roll of mobility. At the end, the acquired units are validated, stored and can be accrued; are Completed gradually until they reach validation (certification contract, stages, workshops, laboratory or further entertainment), in accordance with the rules and best practices in force in the Member State of origin or the host. Ii. Transfer: ECVET- USA serves to establish the comparison or equivalence between experiences act in several contexts different by public urban and street arts spaces. In this scenario, the paths of entertainment are interchangeable and replaceable, and also the experience and validated may exempt a person from portions of standardized training activities that are not indispensable. Thanks to ECVET-USA when an agreement permits, a person can learn independently at different times by relying on the experience already gained in several passages from a VET system to another (for example, from a position of non formal experience in a formal ), transferring and preserving the benefits of learning in the context of a transnational mobility and independently programmable always certifiable. • 1.6 USING A SYSTEM OF CAPITALIZED ACCUMULATION AND TRANSFER UNITS IN URBAN AND STREET ARTS The system of accumulation and transfer of capitalized units is useful for artists, public administrations, students, businesses and educational systems, because it promotes and facilitates the development of such systems nationally and provides added value to the construction of a European Area of the Arts. I. For artists A unit capitalized system allows artists to contribute in the emergence empowerment of the “social value of the arts” and at the same time get a diploma, a professional certification or the recognition of the completed stages, within the framework of national standards. All artists (young adults, unemployed looking for opportunities, part-time employees or amateurs…) can learn in the manner and within the time they deem most appropriate. This improves accessibility qualifications, motivates and encourages people to continue in an effort to conclude the path engaged. In this way we build the project individual experience, learning and training, enpowermwnt of job throughout their life. At the European level, ECVET-USA allows artists to obtain maximum benefits arising from periods of transnational mobility. Ii. For systems of qualifications standards A capitalized system unit facilitates reading, comparing and synergies of ESC with the KSC characterizing the qualifying standard capitalized in the industrial and commercial sectors. So are encouraged authorities, institutions and actors VET, responsible for the definition and implementation of qualifications, to define, organize and disseminate in order to improve readability, the homogeneity of the same standard by establishing practices transferability of negotiation within the framework of public social relations (labour agencies utilities), Interprofessionals (accreditated regional operators) and industrial (trading company) in order to ensure greater transparency of qualifications equivalence for better access to the regulated labor market by the liberalized artists professionals. For example, activities with certified titles spendable only in the context of limited experience or territories from entry barriers (requirements of securities, licenses or qualifications) can allow extra preventive bargaining on the part of individuals (including corporate). Iii. For organizations, institutions dealing with education and vocational training The implementation of a system of units encourages organizations and entities of the standard VET system to define clear objectives and specific learning function needs for the emergence and conceiving of training provision more attractive and more relevant to programs contents and organization. This would encourage players to develop a trained adaptable training supply to beneficiaries, offering personalized routes and flexible (for example organized training modules) and pre-competitive innovative programmes. At the European level, ECVET-USA helps institutions and organizations of the system VET - To communicate their training offer to stakeholders - To cooperate at international level - To conceive and tackle guidance and accompanying measures simplified by the Sustainable Mobility - To organize, plan the offer in reference to outgoing mobility of people in training. Iv. For-profit sectors and enterprises A system unit makes professional training opportunities, nationally, more economical for social partners, businesses, groups and sectors and facilitate relations between them. Companies have the ability to select and propose programs that match the experience actually in the needs of their employees or to the needs of the enterprise; qualifications training will be adequate to the needs of different professional sectors and promote the development of the training of professional adults artists and their conscious and sustainable flexibility. At the European level, ECVET-USA makes professional training opportunities in other Member States more transparent for workers and businesses as unity and points of credit, make more easy understanding of learning acquired by people in a member state other than the original. 2. TECHNICAL REQUIREMENTS • 2.1 UNITS OF ENTERTAINMENT On the technical side, the system ECVET-USA is based: - On structuring the unit qualifications - On description of the contents of the unit as expected results from experience in terms of ESC. The definition and description of ESC, as well as the content and organization of the units, are the exclusive responsibility of regional and national leaders of qualifications and of course shared by the responsibility of owners. I. Features of a unit One unit is characterized by the description of the results of learning in terms of: -ESC - that compose it -Ceiling-reference, the level of a unit is normally less than or equal to the ceiling territory of qualification to which the unit belongs, but it could also be an intermediate level for the emergence of adaptability to training. The characteristics are independent of the mode of experience or training approach but they are all equally capitalized with donations (tipically “hat” in street arts) for the year if they are present in the experience. The units can be characterized according to the ESC typical of each experience or qualifications; identify different types of units: transverse or specifications, general or specialized mandatory or optional, etc.. The units can be interconnected as ordered, hierarchical, progressive or independent and autonomous. Some units are specific practices for mobility, in the case of language skills or Intercultural, can involve one or more units together. The unit must have at least the following characteristics: - Readability and comprehensibility - Coherence and cohesion - The possibility of evaluation and validation. Ii. The three main functions of the unit The unit brings together three main functions: - Information players The unit assumes an essential information resource considered, both for Artists, for the institutions and organizations of the VET system, as characterizing the position in terms of ESC. - Evaluation of the exhausted and rehearsed The unit describes the partial or total results expected for all or part of the experience taken as part of a modular program or entertainment, training, act or other learning activities; it specify requirements and criteria for evaluation. Validation of the learned (acquis) One, attributed to an artist or a company respond in a concrete validation of ESC and highlights progress in the path of cooperation. Iii. Capitalization-accumulation units The units are recognized whatever type of entertainment. Indeed, the same experience can be obtained • with programs or entertainment modules for different duration and evaluation mode • non formal entertainment that are outside the formal education system and Training • through informal entertainment (self-learning work, professional experience and personal welfare-to-work…) • with different methodologies in order to length (full-time, part-time, in training Intensive / Quick, distance learning). As artists add experience, the units completed are evaluated, certified, earned and saved to obtain the qualification for teaching or training. The provisions relating to the period of validity of the units for the purposes of obtaining a full qualification (teaching and learning) or partial, are determined by the owner and by local or national authority. Iv components unit The unit is composed of a set of ESC in connection with capitalized certifications, professional and / or with the industry and is a subset of the acquired during learning in order to have a qualification of the result. The composed ESC of the units are defined in a rule, in a catalog, in a standard or any other valid document at the national level. The set of common principles for the qualitative and quantitative aspects of the development units will be developed at European level by ECVET-USA. The formulation and presentation of the units depend on the methodology adopted by competent authority and provide information on: -Title of generic unit (activities) - EQF Reference level, which may or may not correspond to that of qualification - List of KSC - Criteria for evaluation - Relative value compared to the full qualification. This regulation governs the vocational training entertainment units in the Metropolitan City of Florence with the goal of promoting particular places of particular historical and architectural value of the metropolitan area with the presence of art activities qualified by mobility and the resindentiality of holders' licence service. 2. The metropolitan area of Florence, hereinafter referred to as "area" includes the territory of the following Municipalitties, here called "area mucipalities": Municipality of Florence Province of Florence Municipality of Impruneta, Municipality of Pontassieve Municipality of Scandicci Article 2-Definition and type of Urban art entertainment service 1. The Urban Arts unit is a public service aimed at undifferentiated public entertainment that meets the requirements of legality and transparency of economic activities quality of social interest, with complementary and integrative function of the activities organized by cultural public authorities of territorial area. On the Municipalities' public ground, is possible the establishment of social entertainment for liveworks exposure, promotion and marketing of works and services under the brand name "Metropolitan Art City of Florence " 2. Holders of license issued by one of the municipalities can play the service, by parking, job on calling or walking across the metropolitan area of Florence, as identified by art. 1, paragraph 2. Article 3-Legislative framework reference under operating title 1. The service is done with the help of mobiility perators in relation to funding multiregional Framework Agreement on street arts and the subsequent adoption of the regional regulation for the services of formal adult entertainment (complementary network EDA). I the conduct of the plenary Conference Unified National Service with the view of competing legislative offices of the House and Senate we can pose a debate about a structural reform of the Arts with the introduction of horizontal and vertical model of a "federalism of public space" in the framework of environmental and social sustainability of the Republic for the implementation of the Kyoto Protocol. Article 4-Subsidiary services for the issuance of securization 1.Holders of licenses for Entertainment Urban Arts part of may, if authorized by the competent authority to issue the grant portrait-painter, dream-painter, musician, mime and other topologies double services for the emerging social entrepreneurship; can certificate not tax receipts to users (for selling or promoting non live performed works in unit), also can issue simple receipt on an unit for non-commercial or personal use, portrait, tarot reader, " busking", having signed by the users for the credit reporting. Holders can also collect metallic currency in order to get reporting of the exchange service of the town (Annonaria police). 2. Police Administration concerned bodies will established an exchange and reporting service for the purpose of building operational financial emission of Vouchers in accordance with the provisions on the trend of liberalized tariffs given by entitled holders of concessions themselves. With ministerial bodies (concert Interior Ministry, Economic and Social Solidarity and Welfare Protocol) it will be useful to establish the socio-economic criteria to legalize self-employment of live performance works (need for a Autority Trust for internal citizens elected offices at the Regional Territorial Entities) than Texts Unique Trade armonized actuation. TITLE II TEMPORARY ADVISORY COMMITTEE OF CONSTITUENT AREA Article 5-Functions 1. It consists of the Advisory Committee area responsible for examining the problems of general character and the expression of opinions, with reference to the unified service and the application or variation of this regulation. Article 6-Composition and nomination 1. The Commission, unique in the area, is established by an act of the President of the Province of Florence and is as follows: A) a Manager of the Culture sector of the Province of Florence that presides, or his Delegate; B) an Area Manager in the Culture sector of the Municipality of Florence, or his delegate; C) from three representatives appointed by the municipalities of Florence and other precisely: A representative of Impruneta, Pontassieve and Scandicci Municipalities; D) a Municipal Police Commander of the Municipality of Florence, or his delegate; E) a representative designated by each of the trade unions of category More representative at national level ; F) a representative designated by each of the associations of street mobility artists more representative at national level; H) a representative designated by the corporate associations on fixed area trades designated by the Chamber of Commerce of Florence 2. Each institution or group of institutions, organization or association, shall designate in addition to the permanent substitute replacing owner in their absence or impediment. Representatives alternates can attend meetings of the Commission, but have the right to speak and vote only in place of corresponding effective representative. 3. The duties of secretary were conducted by an employee of the Province. Article 7-Constitutive operation and termination modes 1. Meetings of the Commission shall be convened by the President who sets the agenda day. The President is also required to gather the Commission within twenty days after receipt of a request for a meeting organized by subject and signed by at least one-fifth of the members of the Commission. 2. The opinions jurisdiction of the Commission must be cast to the first or the second convocation useful in the event of effect of this term without the commission has expressed, the organ responsible for the final measure can proceed in the acquisition regardless of the opinion. The Commission takes remains in office until the appointment of a successor until its dissolution. 10. The operation of that Commission is governed by regulations . TITLE III METHOD OF PLANNING AND STANDARDIZATION Article 8-List of istances and applications 1.
